This Privacy Statement describes Travelog Online's practices regarding the collection, use and disclosure of the information we collect from and about you when you use Travelog Online's Business Application (the "Application"). We take our obligations regarding your privacy seriously and have made every effort to draft this Privacy Statement in a manner that is clear and easy for you to understand. By accessing or using the Application, you agree to our Terms & Conditions and to this Privacy Statement.
1. Our Collection and Use of Information
Information You Provide to Us
We collect personal information, such as your name and email address, when you subscribe to our Application. Your name, email address, and any information that we require you to associate with your Account is referred to herein as your "Contact Details".
We will use your Contact Details to send you Application-related notices. These include system-generated notifications, SMS messages and invoices as they are generated in due course of using our Application.
Even if you are not a registered user of our Application, if you email us we may retain a record of such email communication, including your email address, the content of your email and our response.
We may also use your Contact Details to send to you any notices as required by law, in lieu of communication by postal mail.
We will utilize a third party credit card payment processing company to collect payment information, including your nominated credit card number and billing address. We will share this payment information with the third party processing company as detailed in. How We Share Your Information. We do not store your payment information.
If you choose to use our Application to invite Entities or Organisations associated with you to use the Application ("Associated Organisations"), we will ask you for the contact details of the Associated Organisation(s) and we will automatically send these Associated Organisations an invitation to use the Application. We store the information you provide to send the invitation, to register if your invitation is accepted.
We will not sell, distribute or lease your personal information to third parties unless we have your permission or are required by law to do so.
We may also use your email address to send you announcements and information about our other products or services that you may be interested in (together, the "Marketing Messages").
From time to time, we may also use your information to contact you for market research purposes. We may contact you by email, phone, fax or mail. We may use the information we collect from you to customise, enhance and improve the Application according to your interests.
If you believe that any information we are holding on you is incorrect or incomplete, please contact us as soon as possible, and we will promptly correct any information found to be incorrect.
Your Content
As set out in the Terms & Conditions, your use of the Application will involve you uploading or inputting various content into the Application (the "Content"). You control how your Content is shared with others via your settings on the Application.
We may view your Content only as necessary:
- to maintain, provide and improve the Application;
- to resolve a support request from you;
- if we have a good faith belief, or have received a complaint alleging, that such Content is in violation of our Terms & Conditions;
- as reasonably necessary to allow us to comply with or avoid the violation of applicable law or regulation; or
- to comply with a valid legal subpoena or request from law enforcement agencies.
We may also analyse the Content in aggregate and on an anonymized basis, in order to better understand the manner in which our Application is being used.
Information We Collect Automatically
- Cookies
We may use technologies like cookies to provide, monitor, analyse, promote and improve the Application.
We may use traffic log cookies to identify which pages are being used. This helps us analyse data about Application traffic and improve our Application in order to tailor it to customer needs. We only use this information for statistical analysis purposes. Overall, cookies help us provide you with a better Application by enabling us to monitor which pages you find useful and which you do not. A cookie in no way gives us access to your computer or any information about you, other than the data you choose to share with us.
You can choose to accept or decline cookies. Most web browsers automatically accept cookies, but you can usually modify your browser settings to decline cookies if you prefer. Please note that this may prevent you from taking full advantage of the Application. - Log Files
When you use the Application, our servers automatically record information in server logs. These server logs may include information such as your web request, how you interact with the Application, your Internet Protocol ("IP") address, your browser, and other such information. - Device Identifiers
When you access the Application using a mobile device, we may collect specific device information contained in your mobile device's "Device Identifier". This Device Identifier includes information such as the type of device you are using and its operating system.
We may use data associated with your Device Identifier to present you with a better user experience of our Application on your device, and to analyse any device-related issues. - Location Information
We do not collect information about the location of the device from which you are accessing the Application.
2. How We Share Your Information
We may share the information we collect from you with third parties as detailed below.
We will display your information and Content within the Application as directed by you
As set out in the Terms & Conditions, by uploading personal information onto the Application, you are granting us a license to use, copy, reproduce, process, adapt, publish, transmit, host and display that information for the purpose of providing you and others the Application, and any associated support.
With Trusted Service Providers and Business Partners
We may utilize trusted third party service providers to assist us in delivering our Application. For example, we may use third parties to help host our Application, send out email updates or process payments. These service providers may have access to your information for the limited purpose of providing the service we have contracted with them to provide. They are required to have a privacy policy and security standards in place that are at least as protective of your information as is this Privacy Statement. We may also store personal information in locations outside our direct control - for instance, on servers or databases co-located with hosting providers.
With Law Enforcement or In Order to Protect Our Rights
As set out in the Terms & Conditions, we may disclose Content and any other information if required to do so by law. We may also disclose Content and any other information to our legal counsel, governmental authorities or law enforcement if we believe that it is reasonably necessary to do so:
- in order to comply with a law or regulation;
- to protect the safety of any person;
- to address fraud, security or technical issues; or
- to protect Travelog Online's rights or property.
In an Aggregate and Non-Personally Identifiable Manner
We may disclose aggregate non-personally identifiable information (such as aggregate and anonymous usage data, platform types, etc.) about the overall use of our Application publicly or with third parties to help us improve the Application.
In Connection With a Sale or Change of Control
If the ownership of all or substantially all of our business changes, we may transfer your information to the new owner so that the Application can continue to operate. In such case, your information would remain subject to the promises and commitments contained in this Privacy Statement until such time as this Privacy Statement is updated or amended by the acquiring party upon notice to you.
3. How We Protect Your Information
The security of your information is important to us. When you enter sensitive information (such as a credit card number) as part of our service, we encrypt the transmission of that information using industry-standard encryption.
4. Risks Inherent in Sharing Information
As set out in the Terms & Conditions, although we allow you control over your Content and take reasonable steps to maintain the security of your Content, please be aware that no security measures are perfect or impenetrable. We cannot control the actions of yourself or other End Users with whom you share your Content and we are not responsible for third party circumvention on the Application.
To the extent that any information you provide, or that is collected by Travelog Online, is personal information for the purposes of the Privacy Act 1988 (Cth)(as amended from time to time) and the Australian Privacy Principles, you agree and consent that personal information from yourself and from people whose information you enter into the Application can be collected, held, disclosed or otherwise used for any purpose, or in any other manner, permitted under the Privacy Act 1988 (Cth) and/or Australian Privacy Principles.
5. International Data Transfer
As set out in the Terms & Conditions, you understand that your use of the Application involves the transmission to and from you of information that may be considered personal and/or financial information. You consent to the transmission by electronic means of such information through the Application, and such consent will be effective at all times that you use the Application.
Use of the Internet and this Application is solely at your own risk and is subject to all applicable State, Commonwealth, International laws and regulations. While Travelog Online endeavours to provide a secure and reliable Application, you acknowledge that the confidentiality of any communication or material transmitted to/from this Application over the Internet cannot be guaranteed.
As such, Content (including personally identifiable information) may be transferred across borders and from your country or jurisdiction to other countries or jurisdictions around the world.
If you are accessing our Application located in a country outside Australia with laws governing data collection and use that may differ from Australian privacy laws, please note that:
- you are transferring Content, including personal information, to a country and jurisdiction that does not have the same data protection laws as the Australian jurisdiction, and
- you consent to the transfer of Content, including personal information, to these countries and the use and disclosure of Content (including information about you) as described in this Privacy Statement.
6. Links to Other Systems and Web Sites
As set out in our Terms & Conditions, we are not responsible for the practices employed by websites linked to, from or within the Application, nor the information or content contained therein. Please remember that when you use a link to go from the Application to another website, our Privacy Statement is no longer in effect and your activities on that third party website are subject to such third party website's own rules and policies.
7. Changes to Our Privacy Statement
If we decide to change our Privacy Statement, we will post those changes to this Privacy Statement, the home page, and other places we deem appropriate so that you are aware of what information we collect, how we use it, and under what circumstances, if any, we disclose it. We reserve the right to modify this Privacy Statement at any time, so please review it regularly. If we make material changes to this statement, we will notify you here, by email, or by means of a notice on our homepage.
